1 William Baltrusch and Baltrusch Land & Cattle Company (William, collectively) sued his brother and business partner Otto Baltrusch, Jr. (Otto) and Ottos wife Frances Baltrusch (Frances) to recover Partnership funds allegedly misappropriated by Otto and Frances for their personal use. The District Court granted Otto and Francess motion for summary judgment, reasoning that Williams claims are barred by the doctrines of collateral estoppel and res judicata. William now appeals the District Courts dismissal of his claims against Frances. We affirm.
